Digital Millennium Copyright Act

OneGift respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to clear notices of alleged copyright infringement.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:

• A physical or electronic signature of the copyright owner or authorized agent
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing and information reasonably sufficient to locate the material
• Your contact information, including address, telephone number, and email address
• A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
• A statement that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

Counter-Notification

If you believe that your content was removed in error, you may file a counter-notification. Your counter-notification must include:

• Your physical or electronic signature
• Identification of the material that was removed and its location before removal
• A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
• Your name, address, and telephone number
• A statement that you consent to the jurisdiction of the federal court in your district

Repeat Infringers

OneGift will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We may also limit access to our services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.

Processing Time

We will respond to valid DMCA notices within 10 business days. If we determine that the material is infringing, we will remove or disable access to the material and notify the user who posted it.
